Executive Affiliate Agreement

Effective Date: June 1, 2025

This Executive Affiliate Agreement (“Agreement”) is entered into by and between Creator Affect (“Company”) and the individual or entity invited to participate in the Creator Affect Executive Affiliate Program (“Affiliate”). By enrolling in the program, you agree to abide by the following terms and conditions.

1. Enrollment in the Executive Affiliate Program

To become an Executive Affiliate, you must:

Be at least 18 years old.
Have been directly invited and approved by Creator Affect.
Have an established brand, social media presence, or professional influence within relevant industries.
Accept these terms and comply with all applicable laws and regulations.

Creator Affect reserves the right to accept or reject any application at its sole discretion.

2. Executive Affiliate Responsibilities

As an Executive Affiliate, you agree to:

Represent Creator Affect as a trusted brand ambassador.
Use only approved marketing materials provided by Creator Affect.
Clearly disclose your affiliate relationship in compliance with FTC guidelines.
Avoid misleading promotions, false advertising, or fraudulent activities.
Not offer incentives, discounts, or unauthorized promotions to potential referrals.

Violation of these responsibilities may result in termination from the program and forfeiture of commissions.

3. Commission Structure & Payments

Commission Rate: Executive Affiliates earn a 40% recurring commission on every referred membership subscription.
Payout Schedule: Commissions are paid twice a month via PayPal.
- The first payout covers referrals made from the 21st of the previous month to the 5th of the current month, with payments issued on the 10th of the month.
- The second payout covers referrals made from the 6th to the 20th of the current month, with payments issued on the 25th of the month.
Tracking & Attribution: Referral cookies last 90 days, meaning commissions are credited if a user signs up within this period.
Chargebacks & Refunds: If a referred member cancels or requests a refund, the corresponding commission will be deducted from future earnings.
No Self-Referrals: Affiliates cannot earn commissions on their own memberships.

4. Restrictions & Prohibited Activities

Executive Affiliates must not:

Use deceptive marketing tactics, including misleading claims.
Bid on Creator Affect’s brand name or trademarks in paid ads.
Use cookie stuffing, pop-ups, or other unauthorized tracking techniques.
Engage in spam marketing, including mass emails or unsolicited messaging.
Promote Creator Affect on websites containing offensive or illegal content.

Failure to comply with these restrictions may lead to immediate termination from the program and forfeiture of any unpaid commissions.

5. Intellectual Property & Brand Recognition

Creator Affect grants Executive Affiliates a non-exclusive, revocable license to use approved branding materials.
Executive Affiliates must not modify, misrepresent, or misuse Creator Affect’s trademarks, logos, or copyrighted content.
As an Executive Affiliate, your affiliation with Creator Affect serves as a brand partnership, helping establish credibility for both parties.
From time to time, Creator Affect may request permission to repost clips, images, or testimonials from Executive Affiliates on our website, social media, or marketing materials. We will always seek prior approval before doing so.

6. Termination & Account Closure

Creator Affect reserves the right to terminate an Executive Affiliate account if:

The Affiliate violates this Agreement or engages in prohibited activities.
The Affiliate’s brand or promotional methods no longer align with Creator Affect’s values.
The Affiliate engages in any behavior that damages the reputation of Creator Affect.

Upon termination, any unpaid commissions may be forfeited at Creator Affect’s discretion.

7. Limitation of Liability

To the fullest extent permitted by law:

Creator Affect is not liable for lost earnings, tracking failures, or technical issues.
Creator Affect is not responsible for indirect, incidental, or consequential damages resulting from participation in the Executive Affiliate Program.

Participation in the program is at your own risk.

8. Modifications to Agreement

Creator Affect reserves the right to update or modify this Agreement at any time. Significant changes will be communicated to Executive Affiliates, and continued participation in the program constitutes acceptance of the revised Agreement.

9. Governing Law

This Agreement is governed by the laws of the State of Arkansas. Any disputes arising under this Agreement will be resolved in the courts of Arkansas.
