Creator Affect Copyright Infringement & DMCA Policy

Creator Affect (“we,” “us,” “our”) respects intellectual property rights and expects all users (“Users”) to do the same. This Copyright Infringement & DMCA Policy (“Policy”) outlines our procedures for handling copyright infringement claims in compliance with the Digital Millennium Copyright Act (DMCA). By using Creator Affect, you agree to comply with this Policy.

1. Reporting Copyright Infringement

If you believe that your copyrighted work has been used or shared on Creator Affect without permission, you may submit a DMCA Takedown Notice to our designated Copyright Agent.

To file a claim, provide the following information:

  • Your name, address, email, and phone number.

  • A description of the copyrighted work that you claim has been infringed.

  • A direct URL or specific location of the infringing content on Creator Affect.

  • A statement that you have a good faith belief that the use of the material is unauthorized.

  • A statement under penalty of perjury that the information in the notice is accurate and that you are the copyright owner or authorized to act on behalf of the owner.

  • Your physical or electronic signature.

2. Response to Copyright Claims

  • Upon receipt of a valid DMCA Takedown Notice, we will remove or disable access to the allegedly infringing content.

  • We will notify the user who posted the content, providing them with a copy of the complaint.

  • If the user believes the content was removed in error, they may submit a Counter-Notification (see Section 3 below).

3. Submitting a Counter-Notification

If you believe your content was removed by mistake, you may file a Counter-Notification to our Copyright Agent.

Your Counter-Notification must include:

  • Your name, address, email, and phone number.

  • A description of the removed content and where it was previously located.

  • A statement under penalty of perjury that you have a good faith belief the material was removed due to misidentification or mistake.

  • A statement that you consent to the jurisdiction of the federal court in your district or, if outside the U.S., that you agree to jurisdiction in the U.S. where Creator Affect is located.

  • Your physical or electronic signature.

Upon receiving a valid Counter-Notification, we may restore the content unless the original complainant files a lawsuit seeking a court order to prevent reinstatement.

4. Repeat Infringers

Creator Affect has a zero-tolerance policy for repeat copyright infringement. Users who receive multiple valid DMCA notices may have their accounts suspended or terminated.

5. Fair Use and Other Defenses

Users posting content must ensure that:

  • They own the rights or have proper authorization to use the content.

  • The content falls under fair use as outlined by copyright laws.

  • They are not violating the intellectual property rights of others.

6. Misuse of the DMCA Process

Filing false or misleading DMCA claims is prohibited. Any user found to be abusing the DMCA process may face consequences, including account suspension or legal action.

7. Changes to This Policy

  • We may update this Policy periodically to ensure compliance with legal requirements.

  • Users will be informed of updates via email and platform notifications.

  • Continued use of the platform after updates constitutes acceptance of the revised Policy.
