Membership Subscription Agreement

Effective Date: June 1, 2025

Creator Affect (“we,” “us,” “our”) values your participation in our platform and is committed to providing a seamless subscription experience. This Membership Subscription Agreement (“Agreement”) outlines the terms and conditions governing your subscription to Creator Affect. By subscribing to and using our platform, you agree to comply with and be bound by this Agreement.

1. Membership Services

Scope of Services: Members gain access to platform features designed to facilitate networking, collaboration, and resource sharing among small business owners and content creators.
Modifications: We reserve the right to modify or discontinue any aspect of the platform at our discretion. Significant changes will be communicated to Members via email and platform notifications.

2. Membership Terms

Eligibility: Membership is available exclusively to individuals aged 18 or older residing in the United States.
Subscription Plans: Details of available subscription plans, including features and pricing, are provided on our website. We may update these plans periodically.
Account Responsibility: Members are responsible for maintaining the confidentiality of their account credentials and for all activities conducted under their accounts.

3. Fees and Payment

Billing: Membership fees are billed in advance on a recurring basis (e.g., monthly), depending on the chosen subscription plan.
Payment Method: Members must provide a valid payment method at the time of subscription. By providing payment information, you authorize us to charge the applicable subscription fees to the designated payment method.
Failed Payments: If a payment is declined, we will notify you and attempt to process the payment again. Continued payment failures may result in suspension or termination of your membership.

4. Refund Policy

No Refunds: Due to the open nature of our platform, all membership fees are non-refundable.
Cancellation After Renewal: If you attempt to cancel your membership but are still charged, we will work with you to resolve the issue, provided you contact us within three (3) days of the charge date.

5. Membership Cancellation

Cancellation by Member: You may cancel your membership at any time through your account settings. Cancellation will take effect at the end of the current billing cycle, during which you will retain access to the platform.
Post-Cancellation Access: After your subscription lapses, your access to the platform will be terminated, and all content you have uploaded will be permanently deleted.

6. Content and Conduct

Member Content: Members may post content, including but not limited to text, images, and videos. You retain ownership of your content but grant us a license to use it as described in our Terms of Service.
Prohibited Conduct: Members agree not to engage in activities that violate our community guidelines, including but not limited to harassment, spamming, and posting illegal content.

7. Privacy and Data

Data Collection: We collect and process personal information as described in our Privacy Policy.
Data Breach Notification: In the event of a data breach, we will notify affected Members promptly via email and platform notifications. For severe breaches, we may request additional information from Members to assess the impact.

8. Termination

Termination by Creator Affect: We reserve the right to suspend or terminate your membership for violations of this Agreement or our Terms of Service.
Effect of Termination: Upon termination, your access to the platform will cease immediately, and all your content will be permanently deleted.

9. Limitation of Liability

To the maximum extent permitted by law, Creator Affect shall not be liable for any indirect, incidental, or consequential damages arising from your use of the platform.

10. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State ofArkansas, without regard to its conflict of law principles.

11. Changes to This Agreement

Notification of Changes: Users will be informed via email and platform notifications before significant updates take effect.
Continued Use: Your continued use of the platform after such notifications constitutes acceptance of the revised terms.
